Effective Date: January 1, 2021

As used in these Terms of Use (“Terms of Use”), “TRHS” means Tift Regional Health System, Inc.

“TRHS Facilities” means: Tift Regional Medical Center; Southwell Medical, a campus of Tift Regional Medical Center; Southwell Health and Rehabilitation; The Sylvia Barr Center; Southwell Medical Clinic; Affinity Hospital Medicine; Affinity Pediatrics; Affinity Pediatrics – Moultrie; Affinity Physicians for Women; Allure Plastic and Reconstructive Surgery; Arthritis and Osteoporosis Center of South Georgia; Georgia Sports Medicine; Anita Stewart Oncology Center; Ocilla Pediatrics; South Georgia Surgical; Southwell Center for Healing and Wellness; Southwell Chiropractic; Southwell Medical Adel Primary Care; Southwell Medical Ashburn Primary Care; Southwell Medical Community Health Center; Southwell Medical Nashville Primary Care; Southwell Medical Sylvester Primary Care; Southwell Mobile Clinic; Southwell School Clinic; Southwell Nephrology; Tift Regional Ophthalmology; Tift Regional Pain Management Center; Tift Regional Sleep Center; Tift Regional Urology; Tift Regional Vascular; Tift Regional Wound Care & Hyperbaric Clinic; and all other practices, clinics and facilities owned and operated by Tift Regional Health System, Inc.

My Tift Regional Patient Portal (“Patient Portal”) provides you with online access to portions of your electronic medical record for care and treatment provided by TRHS Facilities which is maintained by us and allows us to communicate securely with you.

Your use of Patient Portal is governed by these Terms of Use, and by using or accessing Patient Portal you agree to be bound by it. “We” and “us” and “TRHS” means Tift Regional Health System, Inc. “You” means the person who uses or accesses Patient Portal. If you are using Patient Portal on behalf of another person as their legally authorized representative, or if you have proxy access to an individual’s Patient Portal account, Patient Portal must be used only for the benefit of the person being represented. It is important to review these Terms of Use periodically as we may modify them in our sole discretion.

URGENT MEDICAL MATTERS: The medical or health care information provided in Patient Portal is not a replacement for proper medical attention. Contact your physician, go to an Emergency Room or call 911 immediately if you are suffering from an urgent medical issue.

Patient Portal maintains limited information about you, such as your name, date of birth, and medical record number. Your personal health information is not separately maintained or managed through Patient Portal.

Patient Portal uses yourTRHS Facility electronic medical recordto confirm your identity when you sign up for Patient Portal. Patient Portal may also include functionality that allows you to access other services or information which are subject to their own terms and conditions and policies. When using Patient Portal, you are bound by the terms and conditions for any specific functionality that you utilize within Patient Portal.

Information in Patient Portal is provided “as is” without warranty of any kind. You should consult with a physician regarding your own condition and how information in Patient Portal or accessed through Patient Portal may or may not apply to you.

You understand that not all of your medical record may appear as part of Patient Portal. Posting of your medical information in Patient Portal, in whole or in part, is at our discretion and the discretion of your physician.

USER RESPONSIBILITIES

By using Patient Portal, you agree to these Terms of Use and our Joint Notice of Privacy Practices, posted on our website: www.tiftregional.com. We may modify these Terms of Use and the Joint Notice of Privacy Practices at any time, and by your use of Patient Portal after such modifications are posted, you agree to those changes.

We assume no responsibility for how you use the information you obtain from Patient Portal. When you download or view information on Patient Portal, you agree to hold TRHS, its officers, employees and agents harmless from any and all damages or claims arising out of, or in any way connected with, your use of the Patient Portal or the information contained on or through Patient Portal.

Information Entered Prior to an Appointment. If you enter information in the Patient Portal in preparation for a scheduled appointment, such information will not be reflected in your electronic medical record until it is reviewed by your provider. If you do not keep your appointment, the information will not be reviewed.

Information that becomes a part of your electronic medical record remains in your electronic medical record even if you stop usingPatient Portal.

Sharing Your Personal Health Information. If you share information available through Patient Portal with another individual intentionally or unintentionally, you acknowledge and accept responsibility for your decision to provide them access to potentially sensitive information and you acknowledge and agree that TRHS shall not be liable for any damages suffered by you or third parties related to the material and information in Patient Portal.

You understand that anyone with access to your login name and password will be able to access your confidential medical information and read and send messages in Patient Portal as if that person were you. It is your responsibility to keep your login and password confidential and to change your password if you feel that its security has been compromised. You understand that `we take no responsibility for, and disclaim any and all liability or damages arising from, a breach of medical record confidentiality resulting from your sharing or losing your password. If we discover that you have inappropriately shared your password with another person or that you misused or abused Patient Portal access privileges in any way, your participation in Patient Portal may be discontinued without prior notice.

Response to Messages Sent Through Patient Portal. We attempt to provide a timely response to messages sent through the Patient Portal. However, staff that needs to respond to your message may not be immediately available. Emergency situations requiring immediate attention should not be submitted electronically. Go to an Emergency Room or call 911 immediately if you are suffering from urgent medical issues. We are only able to respond to messages sent by the patient based on the information provided by the patient. If there is insufficient information provided, we will be unable to provide accurate and reliable responses.

Availability of Patient Portal. Patient Portal may not always be available to you due to system maintenance, back-ups or failures. Access is provided on an “as is available” basis, and you are not guaranteed access at any particular time. During times when Patient Portal is unavailable, you are encouraged to use other traditional communication methods to retrieve necessary medical information.

Patient Portal Participation. An individual must be at least eighteen (18) years old to participate in Patient Portal.

Proxy Access to Patient Portal Accounts for Minors. A parent or legal guardian of a minor (individual who is less than eighteen (18) years old) may establish a Patient Portal for the minor and access to the account for the parent or legal guardian (proxy access) by completing and submitting the Minor Proxy Access form available at www.tiftregional.com. Such access will be granted to individuals with parental rights or legal guardianship over the minor and only to the extent that the individual requesting proxy access has the right to access the minor patient’s medical information. The following access to a minor’s Patient Portal is available: If the minor is age 0 to 11 years: full access; and if the minor is age 12 to 17 years: partial access, e.g., immunizations and appointment scheduling. If the proxy’s legal relationship with the patient changes, the proxy must inform TRHS immediately. We reserve the right to revoke proxy access at any time for any reason.

Proxy Access to An Adult’s Patient Portal. Individuals may request proxy access to the Patient Portal account of an Adult (individual who is eighteen (18) years of age or more) by completing and submitting the appropriate Adult Proxy Access form available at www.tiftregional.com. Such access will be granted to individuals with the Adult patient’s consent or direction through a valid advance directive or health care power of attorney. If the proxy’s legal relationship with the patient changes, the proxy must inform TRHS immediately. We reserve the right to revoke proxy access at any time for any reason.

Legal Representative. You understand that if you have appointed a legal representative, such representative will be able to access your Patient Portal account and all the information in the account. In addition, such representative may take action on your behalf through Patient Portal. It is your responsibility to choose an appropriate authorized representative and we are not responsible for actions taken by your representative. If you no longer wish for an authorized representative to have access to your account, you are responsible for revoking such access.

Patient Portal is configured to be secure from unauthorized access, but TRHS cannot be held responsible for: (i) absolute security of all electronic communication transmissions; (ii) unauthorized disclosure resulting from a user not logging out of an active session; (iii) unauthorized disclosure resulting from a lost or stolen user ID and password; (iv) unauthorized disclosure resulting from personal computer settings or installed software products that may compromise information security; or (v) similar events outside of the control of TRHS.

Your Ability to Edit and Delete Your Information or Your Connection. Should you decide that you no longer wish to usePatient Portal, you no longer wish to receive communications throughPatient Portal, or if you wish to edit or delete your information that is maintained in Patient Portal, please contact us at mytiftregionalpatientportal@tiftregional.com or 229-353-6110.

Notification of Changes to these Terms of Use. These Terms of Use may be revised from time to time as we add new features and services, as laws change, and as privacy and security practices evolve. However, we will take reasonable steps to notify you of material changes we make to these Terms of Use. We display an effective date on these Terms of Use above so that it will be easier for you to know when there has been a change. You are responsible for regularly reviewing these Terms of Use. Your continued use of Patient Portal constitutes your acceptance of the revised Terms of Use.
